Nor was the recreational boating skipper, as the investigators felt he had suffered enough because of the loss of his boat. It is our belief that had the Antaeus/Gypsy incident involved a commercial vessel there would be a full-blown investigation, whether the incident involved serious harm or not. The Gypsy was engaged in a legitimate activity in an area clearly identified as an Anniversary Day racing area and the Antaeus was clearly in gross breach of the collision regulations of Maritime Rule part 22, resulting in a serious harm incident. One has to question why Maritime NZ decided to pass the investigation on to a local body with much lower powers of compliance and far fewer resources for investigation. Hayton advised their skills and training and powers to effect compliance with the harbourmaster's instructions and maritime rules are limited to two levels: offenders can be issued with an infringement notice and fined $100, or in more serious cases, a fine of $200. This is in effect a slap on the cheek with a wet ferry ticket. When asked why Maritime NZ did not investigate the incident, based on his report, Hayton replied: "I do not know, you will have to ask Maritime NZ." Once the Gypsy had been salvaged by Total Marine she was taken to the Wooden Boat Shop in Henderson, where the cost of repairs was assessed to be close to $270,000. We understand the Gypsy was insured for some $70,000. As we go to press, it's sad to hear that Pryor may have decided not to repair the Gypsy as it is far too expensive after he had just spent so much time and $100,000 on restoring her. One must now ask if Charles St Clair Brown will man up and do the right thing by paying the difference to ensure the people of Auckland can once again enjoy the sight of this classic yacht out on the harbour.
