General Information & Conditions Your booking contract is with Australian Pacific Touring Pty Ltd (APT), herein after referred to as 'The Company'. Your contract incorporates all of the following terms and conditions. You should read and understand your contract, and ask The Company or your travel agent if you require any clarification. Prices – Deposits – Discounts – Payments Your booking price will be set out in this brochure unless it is varied by advertising or a special offer, or is increased after the publication date to cover changes in government taxes and charges, exchange rate variations, fuel surcharges or other material increases by suppliers. Once you pay your deposit your tour/cruise price is guaranteed (excluding air, taxes and fuel surcharges). For all new bookings a $1,500 deposit per person is required, except for all Antarctica tours where a $3,000 security deposit per person is required, unless otherwise specified. The deposit is due within seven days of booking confirmation. Final payment is due 100 days prior to departure unless stated in the terms of a special offer. Children under twelve years of age are not recommended to participate on an escorted tour. Children under 18 years of age must be accompanied by an adult. The Company reserves the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by The Company within the specified time. All fares are in Australian currency. Credit card surcharges apply. Cancellation Policy For all tours within this publication, the following cancellation conditions apply: Days of Notice 90 days or more 89-60 days 59 days or less Fee Per Person Loss of deposit 50% of tour fare 100% of tour fare All cancellations must be received in writing by The Company and are not effective until this notification has been received. If tour has commenced, 100% of the full tour price is charged. There is no refund for unused services or if portions of the cruise and/or land arrangements are missed. Cancellation fees also apply to additional accommodation reserved prior to and after the tour. These cancellation fees are in addition to any fees that may be levied by your travel agent. Any air or third party fees, maybe incurred as a result of amendments or cancellations. APT Deposit Cancellation Cover *Conditions apply. Deposit held in credit will exclude fees imposed by 3rd parties including – but not limited to – airlines, rail, hotels and non APT cruise lines. When travelling on a Fly Free or Companion Fly Free offer, the deposit paid is used towards ticketing the airfare. APT reserves the right to ticket air at their discretion and this may be done upon receiving deposit. Once airfares are ticketed, applicable airline cancellation fees will then apply and cannot be held in credit. Deposit Cancellation Cover applies to new bookings only. After five years, unused credit funds will incur the original cancellation conditions as per brochure. This does not replace travel insurance, which we strongly recommend is organised at the time of booking. Late Bookings Payment in full is required at time of booking for reservations made less than 100 days before departure from Australia or New Zealand. If a reservation cannot be confirmed, all monies will be refunded. Amendment Fees A charge of $50 will apply to any addition or modification requested after the original booking has been confirmed. Included in our Tour Price All flights within South America, minimum airport taxes, coach/cruise travel, gratuities for all land arrangements including local guides, drivers, restaurants etc, gratuities for cruises, port charges if applicable, accommodation, sightseeing (shore excursions on cruises as stated in itineraries), admissions, luggage service (one bag), services of an APT Tour/Cruise Director and meals (as indicated in the itinerary). Not Included In Our Land Tour Price Airfares between Australia or New Zealand and South America, optional tours, optional shore excursions, meals other than those specified in the itinerary, drinks, laundry, passport and visa fees, excess baggage, vaccinations, government taxes and items of personal nature. Changes to flight schedules may require you to book additional accommodation and services at your own expense. Ticket to return to Machu Picchu on the second day in Aguas Callentes. Economy flights within South America and airport taxes are included in the price. These flights must be booked by APT and are subject to change. The internal air is subject to passengers booking an international flight to South America with an airline that's part of the oneworld Alliance. Airport taxes listed on itinerary pages are an estimate only and are subject to change without notice. Internal air prices are valid at the time of publication. Surcharges may apply for all departures. Flights Within South America The involvement of airlines, rail, boat or any other relevant operator is as air, rail, sea and road carriers only. They shall not be responsible for statements in this publication relating to the transport arrangements. The Company shall indemnify these operators against any claim action, loss or damage arising therefrom. Indemnities 1. Our products include the services of operators, such as hoteliers, airlines, cruise companies & other operators, who are not agents, servants or employees of APT. Although we take care in selecting the operators of services & the optional tour excursions, we cannot & do not take responsibility for the conduct of the operators, their servants & agents or for any ramifications of that conduct. These tours may include activities such as climbing, exploring, swimming & snorkelling. The passenger accepts that these activities involve varying degrees of risk. Limitation Of Liability Limitation of liability in the event of Force Majeure In the event that APT cancels or changes your travel arrangements in any way due to a Force Majeure event, APT will not be liable to you in contract, tort, statute or restitution for any loss (including but not limited to loss of deposit or purchase price & loss of enjoyment), damage, costs, charges, expenses or injury resulting from or in connection with (whether directly or indirectly): (a) the cancellation or change to your travel arrangements; &/or 2. No passenger will be permitted to embark or continue on any cruise/tour while their mental or physical condition is, in opinion of any representative of APT, such as to render them incapable to care for themselves, or whereby they became objectionable to other passengers, or they became a hazard to themselves or other passengers. APT will not be responsible for expenses resulting in such persons being precluded from completing the tour for any reason. 3. APT accepts no responsibility for any death, injury, illness, loss (including loss of enjoyment), damage, detention, delay (including mechanical breakdown) beyond its reasonable control. 4. Any term, condition or warranty express or implied by statute or otherwise for the products &/or services is excluded to the full extent permitted by law. However, nothing in this booking contract excludes, restricts or modifies the application of the Competition & Consumer Act 2010 (Cth) as amended, consolidated, supplemented or replaced. 5. To the full extent permitted by law, APT's liability arising under or in connection with this booking contract: (a) is limited to the re-supply of the products &/or services or the payment of the cost of re-supply of the products &/or services to you; & (b) excludes liability for any indirect or consequential losses suffered by you or any third party, howsoever caused, including but not limited to pure economic loss or any special, extraordinary or punitive damage to you or any other party. 6. Your travel agent will forward deposits & other payments to us on your behalf, but your travel agent is not our agent for the purpose of receipt of monies. Receipt of deposits & subsequent payments by the travel agent does not constitute receipt of those monies by us & the travel agent has no authority expressed or implied to receive monies on our behalf. There is no liability on the part of APT in respect to any monies paid to your travel agent unless & until APT notifies you (by way of a booking confirmation advice or payment receipt advice) that monies have been received by APT. APT reserves the right to cancel any ticket or booking or refuse to carry any passenger where payment has not been received by APT within the specified time. If a problem occurs during your cruise &/or tour, in your own best interests, you should advise your Tour/Cruise Director so that steps can be taken to resolve the matter on the spot. Any complaint must be made in writing to us within 30 days. Service Inquiries Force Majeure Force Majeure means the occurrence of an event that is beyond APT's reasonable control & which could not have been reasonably prevented by APT, which includes but is not limited to: (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (c) nuclear or other industrial accident causing environmental pollution or contamination; &/or (d) change in law, meaning enactment, amendment (including repeal) in the law or administration of any law in Australia or any jurisdiction or territory relevant to the booking contract, which include changes in statute, regulation, determination, by-law, declaration, licence & includes the common law as applicable from time to time. (b) natural disaster (including but not limited to flooding, fire, earthquake, landslide), adverse weather conditions, high or low water levels; (b) change your travel arrangements as reasonably practicable to ensure your safety & invoice you for any additional costs of performing this paragraph. (a) terminate the booking contract (in whole or in part); &/or Termination of booking contract or change of travel arrangements due to Force Majeure If APT, in its reasonable opinion, considers that any Force Majeure event prevents APT (whether directly or through its employees, contractors, subcontractors & agents) from lawfully &/or safely providing any products &/or services subject of the booking contract to you, APT may immediately by written notice: (b) the Force Majeure event. For the avoidance of doubt, APT is not liable to refund any part of the deposit &/or purchase price paid by you if APT subsequently changes or cancels your travel arrangements in connection with a Force Majeure event. World weather, civil unrest and terrorism are becoming more erratic and unpredictable & these are risks beyond APT's control. It is your responsibility to purchase adequate comprehensive insurance to protect yourself against these risks. Medical Assistance The Company does not employ medical staff on our tours. Should you require medical attention, local medical services can be contacted immediately. You are responsible for all charges that result from visiting a medical facility, or for a medical practitioner visiting you. The Company is not responsible for the type or quality of the medical services you may receive. Itineraries are subject to alteration without notice and intended as a guide only, in particular Galapagos Islands Cruise itineraries are subject to change without notice. Alterations may come about due to road, weather or tidal conditions, strikes, public holidays, local festivals or other reasons. Due to the nature of the terrain and remote areas, weather fluctuations can adversely affect road conditions which may necessitate alterations to itineraries with little or no notice. Any additional expense incurred by the passenger is not The Company's responsibility. The Company can give no guarantee as to the exact arrival and departure times for carriers and operators used by The Company in the tour and The Company will not be liable for failure to make connections with any other services or attractions beyond its control. As is normally the case with group tours, a minimum number of bookings is required in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate numbers cannot be achieved, it may be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or a full refund of monies paid for ground content touring). The date on which the decision is made whether a tour will operate is usually four to eight weeks before the scheduled departure date. The maximum group size is 28 passengers for the land arrangements, cruising is subject to the size of the ship. On rare occasions the group size may exceed 28 for part of the tour only. Itineraries It is our aim to camp on every voyage, but this activity is dependent on favourable weather and ice conditions. Camping in Antarctica Airport transfers in are included on the first and last day of your tour package. Passengers that book pre/post accommodation and airfares will be transferred to/from the airport. No refund will be given for unused transfers. Transfers cannot be re-routed to other pick-up points or destinations. Passengers who miss the pre-booked transfers must make their own way to/from the ship/hotel at own expense. Transfers must be booked and details advised to The Company at least 60 days prior to travel, otherwise transfers cannot be guaranteed. Airport Transfers Luggage Limit Each passenger is entitled to take one case, the sum of its length, width and depth not to exceed 160 cm (63 inches), weight limit 20 kg. Airlines permit only one cabin bag per person, in which personal items such as cameras, make-up etc. should be carried. Over-limit luggage cannot be carried. Baggage is at 'owner's risk'. Travel Insurance We strongly recommend passengers take out travel insurance to cover any unforeseen circumstances that may arise (including cancellation fees, medical and curtailment expenses, loss of luggage, early departure from tour due to death or illness etc.). Ask your travel agent for details at the time of booking.
