TERMS & CONDITIONS However, Travel Impressions, Ltd. offers refunds under this agreement with the express understanding that endorsement of a refund by participant(s) constitutes a waiver of any such additional rights and remedies against Travel Impressions, Ltd. See "Cancel for Any Reason Waiver and Travel Protection Plan" below. CANCEL FOR ANY REASON WAIVER AND TRAVEL PROTECTION PLAN: The Cancel for Any Reason Waiver and Travel Protection Plan ("Plan") contains both non-insurance (Section I) and insurance (Section II) components. Enrollment in the Plan is optional and once enrolled, the cost associated with the Cancel For Any Reason Waiver portion of the Plan will not be refunded. Section I Cancel For Any Reason Waiver is a non-insurance component and is provided by Travel Impressions, Ltd. Section II of the Plan is underwritten by Transamerica Casualty Insurance Company, Columbus, Ohio; NAIC # 10952 (all states except as otherwise noted) under Policy/Certificate Form series TAHC5000. In CA, HI, NE, NH, PA, TN and TX Policy/Certificate Form series TAHC5100 and TAHC5200. In IL, IN, KS, LA, OR, OH, VT, WA and WY Policy Form #'s TAHC5100IPS and TAHC5200IPS. Certain coverages are under series TAHC6000 and TAHC7000. If you are a resident of one of the following states (IL, IN, KS, LA, OH, OR, VT, WA, or WY), your plan is provided on an individual form. Section II is offered through Travel Impressions, Ltd., which holds an agent or producer license in all requisite jurisdictions*. This plan provides insurance coverage that applies only during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home and automobile policies. CHOICE OF LAW; RESOLUTION OF DISPUTES: This Agreement is governed by the laws of, and disputes shall be venued in, the State of New York, without reference to its choice of law doctrine. All disputes, claims or controversies arising out of or related to the services of this agreement shall be submitted to mediation and if the matter is not resolved through mediation, it shall be submitted for arbitration. Unless we agree otherwise in writing, any mediation and/or arbitration shall take place in the State of New York, New York County, and shall be administered by, and pursuant to the rules of, the American Arbitration Association. Disputes shall be arbitrated on an individual basis. There shall be no right or authority for any disputes to be arbitrated on a class action basis or in a purported representative capacity on behalf of the general public, other travel customers or other persons similarly situated. The arbitrator's authority to resolve disputes and to make awards is limited to disputes between you and us alone, and is subject to the limitations of liability set forth above. Furthermore, disputes brought by either party against the other may not be joined or consolidated in arbitration with disputes brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision shall be given preclusive effect as to issues or claims in any dispute with anyone who is not a party to the arbitration. Should any portion of this section regarding the arbitrator's authority to resolve disputes between only you and us be stricken from this agreement or deemed otherwise unenforceable, then this entire section shall be stricken from this agreement. The provisions of this section may be enforced in a court of competent jurisdiction and the party seeking enforcement shall be entitled to an award of all costs, fees and expenses (including attorney fees), to be paid by the party against whom enforcement is ordered. This arbitration provision is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act, 9 U.S.C. Sections 1-16, as it may be amended. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. For further information contact your airline representative. Violation of these restrictions will result in imprisonment and financial penalties. PROPER ENTRY/RE-ENTRY REQUIREMENTS: Requirements as outlined below may change, so see your travel agent or contact the consulate for the country to which you are traveling to be accurately advised of current requirements. Proper documentation is your responsibility. The following information gives current requirements for United States citizens, effective at time of printing: Passengers of all ages returning to the U.S. by air from any international destination must have a valid passport in good condition, and passengers may be denied boarding by the airline if passport is damaged, mutilated, or has excessive wear. A state-issued birth certificate with government issued photo I.D., or a passport "card", is not acceptable. If your name on your passport (or for non-U.S. citizens, valid travel documents) does not match your name on your travel vouchers/tickets, you will not be allowed to travel. All passengers 18 and over traveling within the United States or to any U.S. territory (including Puerto Rico and the U.S. Virgin Islands) require only a valid government-issued photo I.D. A passport valid for up to 6 months past the date of return is required for U.S. citizens traveling to certain countries. Check with the consulate or embassy of the country to which you are traveling for specific requirements. For details on how to obtain a passport, contact your local courthouse or post office. If you are not a U.S. citizen, contact the embassy of the country to which you are traveling to determine required entry documents. We regret that we cannot accept unaccompanied minors under 18 for any travel. Failure to comply with these requirements will result in you not being allowed to travel. DENIAL OF ENTRY: Certain countries have specific rules and policies concerning entry of travelers with criminal records. Anyone with even a minor criminal past may be denied entry into any foreign country or even entry back into the United States if you are not a U.S. Citizen. If you have a criminal record, it is important to check with the United States Embassy and the embassy or consulate of the country you wish to visit to ensure you can travel as planned. HEALTH AND SAFETY TIPS: While most travel–domestic and international–is completed without incident, travel to certain destinations may involve more risk than travel to other destinations. Travel Impressions, Ltd. urges passengers to review current travel advisories, warnings and restrictions issued by the United States government before booking any travel. In addition, passengers are responsible for determining and obtaining proper documentation for travel to international destinations. Travel Impressions, Ltd., as an Active Member of USTOA, is required to post $1 Million with USTOA to be used to reimburse, in accordance with the terms and conditions of the USTOA Travelers Assistance Program, the advance payments of Travel Impressions, Ltd. customers in the unlikely event of Travel Impressions, Ltd. bankruptcy, insolvency or cessation of business.
