102 Terms & Conditions TRAVEL IMPRESSIONS TERMS & CONDITIONS SECTION 2. ADDITIONAL TERMS AND CONDITIONS APPLICABLE TO PUBLIC CHARTER FLIGHTS/DEDICATED VACATION FLIGHTS: Please read and accept the following Terms and Conditions which govern your purchase of a Public Charter Flight. Payment for your travel constitutes acceptance of these Terms and Conditions. AIR CARRIERS: Travel Impressions, Ltd. has made arrangements to sell Public Charter Flights operated by Apple Vacations, LLC ("Operator"), located at 7 Campus Boulevard, Newtown Square, PA 19073. Operator has made arrangements for international air transportation to your vacation destination via certified charter carriers filed under Department of Transportation (D.O.T.) regulations. Any air transportation provided by a certified charter air carrier may not be cancelled less than 10 days prior to the scheduled departure date unless it is physically impossible to operate the flight. For international flights only, additional restrictions may imposed on the flight by the foreign government involved, and if landing rights are denied by a foreign government, the flight will be cancelled with a full refund to the participant. All public charter flights on Alaska Airlines PC14-095 (B737-800/162 seats), AeroMexico PC14-102/PC14-114 (B737-800/159 seats), Frontier Airlines PC14-063 (A320/180 seats), Frontier Airlines PC14- 064 (A319/150 seats), Interjet PC14-159 (A320/150 seats), Icelandair PC14-122 (B757-200/183 seats) and Xtra Airways PC-14-120 (B737- 400/162 seats) are operated by Apple Vacations, LLC. The airline reserves the right to substitute alternate aircraft if necessary. This information is current at time of printing (Feb. 2015). Deposit Requirements: For vacation packages on public charter flights that are eligible for a deposit, the required deposit for bookings made outside of 45 days prior is $150 per person, plus the cost of the Cancel for Any Reason Waiver and Travel Protection plan, if selected. CHARTER OPERATOR CANCELLATIONS/MAJOR CHANGES Cancellations: Charter flights will not be cancelled by Operator less than 10 days before the scheduled departure date except for circumstances that make it physically impossible to operate the flight. In the event of cancellation, a refund will be made within 14 days. Major Changes: A "major change" constitutes any of the following: a change in the departure or return date which Operator knows more than 2 days before the scheduled flight date, unless the change results from a flight delay; any charter flight delay of more than 48 hours; a change in the origin or destination city for any flight leg, unless the change only affects the order in which cities in a tour package are visited; a substitution of any hotel; or a price increase occurring 10 or more days prior to departure and resulting in an aggregate price increase of more than 10%. Notice: Notice of any cancellation or major change will be given within 7 days after Operator is made aware of such a change, but in any event, at least 10 days prior to departure. If Operator first knows of a major change or if the charter is cancelled for circumstances which make it physically impossible to operate the flight within 10 days of departure, you or your travel agent will be notified as soon as possible. REFUND FOR MAJOR CHANGE: Upon notification of a major change, you will have the option to cancel without penalty within the 7 days following receipt of notification, but in no event later than departure, and a full refund will be made to you within 14 days after cancellation. If notification of a major change is received after departure, you may reject the major change and receive a refund of the portion of your payment allocable to the hotel or air transportation not provided within 14 days after the return date. AMENDMENTS AND CANCELLATIONS: If you cancel your vacation or change your departure date, flight, duration, class of service, name, departure city, or destination on a public charter flight, the charges shown below become payable by you. Note: Some hotels do not allow name changes. Change fees apply to departure date, flight, duration, class of service, departure city and destination changes. Your travel agent must notify Travel Impressions immediately of any changes or cancellations. All communications pre-departure must be via your travel agent. If you provide a substitute participant on a vacation, cancellation charges will be waived, but change fees apply; restrictions may apply. If the number of individuals occupying a room changes due to an amendment or cancellation, the remaining travelers will be responsible for any additional costs incurred as a result of a change in the per person occupancy rate. If all passengers change it is considered a new booking and cancellation penalties will apply. Suppliers' cancellation provisions on optional tours only allow a refund if cancelled with the notice required by the supplier - see the excursion company for the applicable notice provisions or to arrange a refund. To cover your cancellation and change fees, you may purchase the Cancel for Any Reason Waiver and Travel Protection Plan which must be included in the deposit or at time of booking online. SECURITY: All public charter flights sold through Travel Impressions, Ltd. are operated by Apple Vacations, LLC. Apple Vacations, LLC has surety trust agreements with Susquehanna Patriot Bank, 101 Bryn Mawr Avenue, Bryn Mawr, PA 19010 for payment of any charter air package refunds as defined by the agreements. Under these agreements, unless you file a claim with Travel Impressions, Ltd., who in turn files with Apple Vacations, LLC (or with the bank) within 60 days after termination of your vacation, both parties shall be deemed released from all liability to you.
